Terms of Service

Welcome to CommitBound. These Terms of Service ("Terms") are a binding agreement between you and CommitBound LLC, a Colorado limited liability company ("CommitBound", "we", "us", or "our") covering your use of our website at commitbound.com, our mobile apps, and related services (collectively, the "Service").

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

1. Who can use CommitBound

• Minimum age: you must be at least 13 years old to create an account. We do not knowingly allow anyone under 13 to use the Service.
• Users aged 13 to 17: you may use the Service, but we strongly encourage a parent or guardian to review these Terms and the Privacy Policy with you. By accepting these Terms, you represent that your parent or guardian has consented to your use of the Service.
• Parents/guardians: you may create an account and link to your athlete's account via Family Mode. By doing so, you agree that you are the parent or legal guardian of the athlete.
• College coaches: you may create an account using a .edu email address. Coach accounts currently receive the Service at no charge. We may change this with reasonable notice.
• Jurisdiction: the Service is offered primarily in the United States. By using the Service, you confirm that you're legally permitted to use it where you live.

2. What CommitBound provides

CommitBound is a recruiting assistance platform for high school student-athletes pursuing college softball (and, over time, other sports). The Service helps you:

• Track daily habits and measure recruiting readiness.
• Research college programs, build a target school list, and organize outreach.
• Share a public athlete profile with coaches (via a link you control).
• Discover tournaments, log coach sightings, and plan your schedule.
• Coordinate with a parent or guardian via Family Mode.

CommitBound is a tool, not a recruiting service. We do not act as your agent. We do not contact coaches on your behalf. We do not guarantee that you will be recruited, receive a scholarship offer, or be admitted to any particular college. Those outcomes depend on your talent, effort, academics, timing, and many other factors outside our control.

3. Your account

• Accurate information: provide truthful information when you sign up and keep it up to date. Inaccurate stats, grades, or graduation year can harm you, other athletes, and coaches who rely on the data.
• One account per person: don't create multiple accounts for yourself or impersonate another person.
• Account security: you're responsible for keeping access to the email address associated with your account (we sign you in via that email). Notify us promptly if you suspect unauthorized access.
• No sharing: you may not share account credentials or allow others to use your account.

4. Subscriptions, billing, and cancellation

Plans and pricing

Athlete accounts receive a free trial (duration shown at signup). After the trial, continued access requires a paid subscription, available as monthly or annual billing. Current pricing is shown at commitbound.com/pricing. We may change pricing with reasonable notice; existing subscribers will be notified at least 30 days before a price change affects them.

Payment processing

Payments are processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis (monthly or annually, depending on the plan) until you cancel. You represent that you're authorized to use the payment method.

Renewal and cancellation

Subscriptions renew automatically at the end of each billing period. You can cancel at any time in the Settings area of your account; cancellation takes effect at the end of the current billing period. You continue to have access until that period ends. We don't lock you into a contract. We don't require phone calls. We don't hide the cancel button.

Refunds

We handle refunds case-by-case within 30 days of payment if you reach out at support@commitbound.com. After 30 days, subscription fees are generally non-refundable. We do not prorate refunds for partial months.

Failed payments

If a payment fails, we'll retry and notify you by email. Continued failure may result in suspension or cancellation of your account.

Taxes

Prices displayed do not include taxes unless stated otherwise. You're responsible for any applicable sales, use, or similar taxes.

In-app purchases

Where the CommitBound mobile app is distributed by the Apple App Store or Google Play Store, subscriptions are not purchased through those stores' in-app purchase systems. You subscribe on commitbound.com via Stripe. The app exists as a companion to your commitbound.com account.

5. Your content and license to us

You keep ownership of everything you upload to CommitBound: your profile information, skill videos and photos, outreach messages, habit logs, training logs, and any other content you create or submit ("Your Content").

By uploading Your Content, you grant CommitBound a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and transmit Your Content for the purpose of operating and providing the Service to you and to the specific people you choose to share with (e.g., a coach who receives your public profile link). This license ends when you delete the content or close your account, except for (a) anonymized or aggregated data we may retain for analytics, and (b) content already shared with third parties acting outside our control.

You represent and warrant that Your Content does not infringe any third party's rights (including copyright, trademark, privacy, or publicity rights), and that you have the rights necessary to grant us this license. If you're under 18, you represent that a parent or guardian has consented to your uploads.

Don't upload content that features other people (teammates, opponents, coaches) without their permission. Don't upload anyone else's copyrighted material (game footage, other athletes' highlight reels) without permission.

6. Acceptable use

You agree not to:

• Use CommitBound to harass, spam, or mislead coaches or other users.
• Provide false or misleading athletic, academic, or identity information.
• Attempt to access other users' accounts or data.
• Use automated tools (scrapers, bots, crawlers) to extract data from the Service without our written permission.
• Reverse engineer, decompile, or otherwise attempt to derive source code from the Service.
• Interfere with, disrupt, or overload the Service or the infrastructure it runs on.
• Use the Service to violate NCAA, NAIA, NJCAA, or other athletic association rules, including rules about contact with college coaches during restricted periods.
• Use the Service in a way that violates applicable laws (e.g., sending spam in violation of CAN-SPAM).
• Upload or transmit content that is illegal, infringing, defamatory, threatening, sexually explicit, or otherwise objectionable.

We may suspend or terminate accounts for violations, with or without notice depending on severity.

7. Family Mode

Family Mode lets a parent or guardian and an athlete link accounts so the parent can view a summary of the athlete's recruiting activity (score, streaks, target schools, upcoming tournaments, outreach status). Either account can invite the other, and either can unlink at any time.

Parents using Family Mode agree that they are the legal parent or guardian of the linked athlete, and they consent to the data flows described in the Privacy Policy. Parents do not see the content of the athlete's emails to coaches or messages from coaches. Parents do receive a weekly digest push and email with the athlete's progress, which they can opt out of in their settings.

8. Coaches and recruiting rules

CommitBound does not verify compliance with NCAA, NAIA, NJCAA, or other governing body rules about contact between coaches and recruits. You are responsible for understanding and following the rules that apply to your division and class year, including restricted contact periods, dead periods, and quiet periods. Nothing we provide (including email templates, coach contacts, and timeline pages) is legal advice or compliance guidance.

If you're a college coach using CommitBound, you agree to follow your institution's and your governing body's recruiting rules. We don't monitor your contacts; that's on you.

9. Third-party services

The Service integrates with third-party services (payment processing by Stripe, email delivery by Resend, sign-in via Google and Apple, AI features powered by Google Gemini, and more; a complete list is in our Privacy Policy). Your use of those services is also subject to their terms. CommitBound is not responsible for third-party services' availability, accuracy, or practices.

10. Intellectual property

CommitBound, the CommitBound logo, the "Get Seen. Be Ready." tagline, and all software, content, design, and functionality on the Service (except Your Content) are owned by CommitBound or its licensors and are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes while these Terms are in effect.

11. Termination

• By you: you may close your account at any time via Settings, or by emailing support@commitbound.com. Deletion is handled as described in the Privacy Policy.
• By us: we may suspend or terminate your account if you violate these Terms, if we're required to by law, or if we discontinue the Service. We'll give reasonable notice except in cases involving safety or security.
• After termination: provisions of these Terms that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law, dispute resolution) will survive.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY CONTENT ON THE SERVICE, INCLUDING INFORMATION ABOUT COLLEGE PROGRAMS, COACHES, TOURNAMENTS, CAMPS, OR RECRUITING TIMELINES.

CommitBound makes no guarantee that using the Service will result in college recruitment, a scholarship offer, or any specific outcome. Recruiting outcomes depend on many factors outside our control, including your performance, academics, physical development, the needs of particular programs, and chance.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL COMMITBOUND BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE, INCLUDING ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (C) ANY CONTENT OBTAINED FROM THE SERVICE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT.

OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID COMMITBOUND IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (USD $100), WHICHEVER IS GREATER.

Some jurisdictions don't allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless CommitBound, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your violation of these Terms, (b) your misuse of the Service, (c) Your Content, or (d) your violation of any rights of another party.

15. Governing law and disputes

These Terms are governed by the laws of the State of Colorado and applicable U.S. federal law, without regard to conflict-of-laws rules. Any lawsuit relating to these Terms or the Service must be filed exclusively in the state or federal courts located in the State of Colorado, and you consent to personal jurisdiction there.

Before filing any lawsuit, please contact us at support@commitbound.com so we can try to resolve the issue informally. We commit to attempting good-faith resolution within 30 days before either party initiates formal proceedings.

16. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. For material changes, we will notify you via email and via an in-app banner at least 14 days before the change takes effect. Continued use of the Service after the effective date of the update constitutes acceptance. If you don't agree with the changes, close your account before they take effect.

17. General

• Entire agreement: these Terms, together with the Privacy Policy, constitute the entire agreement between you and CommitBound regarding the Service.
• Severability: if any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
• Waiver: our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
• Assignment: you may not assign these Terms. We may assign these Terms (e.g., to a successor entity) with reasonable notice.
• Notices: legal notices to CommitBound must be sent to legal@commitbound.com. Notices to you will be sent to the email associated with your account.
